CONDITIONS OF USE

WARRANTIES AND LIABILITY

Warranties

The products presented on www.orianacosmetic.com benefit from the legal guarantee of conformity (article L 211-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (article 1641 et seq. of the French Civil Code). All warranties are excluded in the event of external damage or damage resulting from abnormal or inappropriate use, negligence or lack of maintenance on the part of the customer. You must comply with the maintenance and cleaning conditions indicated on the products.

Article L217-4 of the French Consumer Code

The seller is obliged to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery.

Article L217-5 of the French Consumer Code

To be in conformity with the contract, the good must be fit for the use usually expected of a similar good and correspond to the description given by the seller.

Article L217-7 of the French Consumer Code

Defects in conformity which appear within twenty-four months of delivery of the goods are presumed to have existed at the time of delivery.

Article L217-12 of the French Consumer Code

Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.

Article 1641 of the French Civil Code

The seller is liable for any hidden defects in the item sold which render it unfit for its intended use.

Article 1648 of the French Civil Code

The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.

Responsibilities

Oriana cosmetic shall not be held liable for any damage resulting from misuse of the products by the Customer or in the event of force majeure. Any event qualifying as force majeure fully exonerates Oriana cosmetic from all liability.

All facts or circumstances that are irresistible, unforeseeable and beyond the control of the parties are considered as force majeure.

Oriana cosmetic cannot be held liable for any inconvenience or damage inherent in the use of the Internet network.

COMPLAINTS HANDLING

In the event of a complaint, the Customer must contact Oriana cosmetic as soon as possible. The Customer must check the condition of the products as soon as they are received. If a product proves to be defective or does not correspond to the order, the Customer must inform customer service before returning it.

Oriana cosmetic will ask the Customer to return the product. In the event of a proven defect or error in order preparation, Oriana cosmetic will refund the price of the product ordered and the initial delivery costs. This refund will be made within 14 days of receipt of the returned product.

In the event of the return of a defective product or one that does not correspond to the order, the cost of return will be borne by Oriana cosmetic.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the Customer must contact the Company for an amicable solution. Failing amicable settlement, any dispute will be submitted to the jurisdiction of the competent courts of the defendant's domicile, the place of delivery or the company's registered office Oriana cosmetic.

CONSULTANT AND TAX

Oriana Cosmetic operates as a consultant site for Chogan. VAT and any tax obligations related to these payments remain the responsibility of Chogan.
